KELUARGA BERENCANA (KB) PERSPEKTIF IMAM AL-GHAZĀLĪ DAN IBNU ḤAZM

Abstract

Family Planning (KB) is one of the issues that cannot be discussed in the realm of Islamic Law. The scholars, both classical and contemporary, differ in their opinion, considering that family planning was de jure unknown in the early days of Islam and there was no legitimizing nash sharih argument. Based on the results of the study, it was concluded that Imam al-Gazālī and Ibn azm in giving legal status to family planning had something in common, namely that they both accepted the Qur'an and hadith as the first and second sources of Islamic law. However, the two have a fundamental difference, namely Imam al-Gazālī condemns family planning as permissible because according to al-Ghazali there is a hadith aḥīḥ which legalizes the implementation of 'azl. On the other hand, Ibn azm ruled that family planning is not allowed or forbidden because there is a hadith aḥīḥ which clearly prohibits it. This hadith is also a hadith that emphasizes other hadiths that allow 'azl. In terms of the legal basis, Imam al-Gazālī relies on the Qur'an surah al-Mu'minun verse 12-14 and the hadith narrated by Jabir ibn 'Abdillah while Ibn Hazm relies on the Qur'an surah al-Takwir verse 8 and the hadith narrated by Judamah bint Wahb.
